Can an insurer reject my claim citing a pre-existing disease I was unaware of?

Not automatically. Insurers must show the non-disclosure was material and deliberate, not an innocent omission of a condition the policyholder had no reason to know about. Many wrongful rejections on this ground do not survive scrutiny before the Consumer Commission or Ombudsman.

What is the Insurance Ombudsman and when should I approach it?

The Insurance Ombudsman offers a free, faster grievance redressal mechanism for individual policyholders with claims up to Rs. 50 lakh, once the insurer's internal grievance process has been exhausted or 30 days have passed without resolution. It is often a useful first step before Consumer Commission litigation.

How long does an insurer have to settle or reject a claim?

IRDAI regulations require insurers to settle or reject a claim within a defined timeframe after receiving all necessary documents, and unexplained delay itself can support a deficiency in service claim before the Consumer Commission, even independent of the merits of rejection.

Can I claim interest and compensation on top of the claim amount?

Yes. Where rejection or delay is found unjustified, Consumer Commissions can direct payment of the claim amount with interest from the date it fell due, along with compensation for mental agony and litigation costs.
