Common Questions

Frequently Asked Questions

What is the time limit for filing a consumer complaint?

A complaint must generally be filed within 2 years from the date the cause of action arose, under Section 69 of the Consumer Protection Act, 2019. Delay can be condoned if a sufficient reason is shown, but it is best to act promptly.

Which Consumer Commission should I approach?

Jurisdiction is now based on the value of goods or services paid for: District Commissions handle claims up to Rs. 50 lakh, State Commissions between Rs. 50 lakh and Rs. 2 crore, and the National Commission above Rs. 2 crore.

Do I need a lawyer to file a consumer complaint?

The Act allows consumers to appear in person, but professional drafting materially improves outcomes — a well-pleaded complaint with the right documents and prayer clause avoids objections and speeds up admission and interim relief.

What compensation can I claim besides a refund?

Commissions can award compensation for mental agony and harassment, litigation costs, and in appropriate cases punitive damages for unfair trade practices, in addition to directing refund, replacement, or repair.
