Who can claim maintenance under Indian law?
A wife, minor children, and dependent parents can claim maintenance under Section 144 of the BNSS (earlier Section 125 CrPC), and spouses can also seek interim and permanent maintenance under the Hindu Marriage Act. The amount depends on the income and needs of both sides.
How do courts decide child custody?
The welfare of the child is the paramount consideration — not the preference of either parent. Courts weigh the child's age, schooling, emotional bonds, and each parent's circumstances, and often grant one parent custody with structured visitation for the other.
What relief is available under the Domestic Violence Act?
The Protection of Women from Domestic Violence Act, 2005 provides protection orders, the right to reside in the shared household, monetary relief, and temporary custody orders. Interim relief can be granted quickly once a complaint is filed.
Can family disputes be resolved through mediation?
Yes. Delhi's Family Courts routinely refer matters to court-annexed mediation centres, and a large share of maintenance and custody disputes settle there. A mediated settlement is recorded by the court and is binding.
