What is the time limit for filing a cheque bounce case?

You must send a written demand notice within 30 days of receiving the bank's return memo. The drawer then has 15 days to pay; if they do not, a complaint under Section 138 of the Negotiable Instruments Act must be filed within the next 30 days. Missing these deadlines can be fatal to the case.

Can I recover money without a written agreement?

Yes. Invoices, delivery records, bank statements, emails, and even WhatsApp messages can establish a debt. The available remedy — ordinary suit, summary suit, or criminal complaint — depends on the documents you hold.

What is a summary suit and when does it apply?

A summary suit under Order 37 CPC is a fast-track civil remedy for claims based on written contracts, cheques, or promissory notes. The defendant must obtain the court's leave to defend, which significantly shortens recovery timelines.

Should I file a civil suit or a criminal complaint for unpaid dues?

They serve different purposes: a Section 138 criminal complaint pressures payment through penal consequences, while a civil recovery suit secures a money decree. In many cases we pursue both in parallel for maximum leverage.
